Privacy, Terms and Conditions


1- EmpPass

I- EmpPass is a digital platform designed for individuals and businesses that offers an automated attendance control system using facial recognition technology. Its goal is to optimize workforce management and reduce payroll losses. It is designed for both large corporations and entrepreneurs, with accessible plans starting from $0.00.

II- EmpPass is a product developed and operated by KUBU Technologies Inc., a Panamanian company dedicated to creating technological solutions.


2- User Responsibility and Platform Usage

I- Users, both individuals and businesses, acknowledge and accept that they are solely responsible for the truthfulness, accuracy, and currency of the information provided during their registration, as well as for their use of the EmpPass platform, both within and outside of it.

II- EmpPass does not own the registered data nor act as an arbiter thereof; its sole function is to provide a technological service that allows companies to manage their staff attendance in a transparent and automated manner, and employees to monitor their own attendance records in real time.

III- Likewise, the user accepts that EmpPass may request and use personal information in accordance with its Privacy Policy. Accessing, registering, or using the platform implies full acceptance of these terms and conditions. If the user does not agree with them, they must refrain from using the platform.


3- Users

I- EmpPass users are divided into two main categories: Employee and Company.

II- Employee User: Users registered as employees can manage their attendance from their personal account. This includes recording their clock-in and clock-out times, viewing their attendance history, requesting leave or vacation, and reporting incidents related to their work schedule.

III- Company User: Users registered as companies can supervise and manage their employees' attendance, as well as approve or reject leave and vacation requests. They will also have access to reports and management tools to optimize workforce management.


4- Permissions and Personal Information

I- EmpPass requests certain permissions within the application to ensure the proper functioning of its services. These include access to the device's camera and photos, for the purpose of allowing the user to create or select a profile picture. Additionally, location access is requested to record attendance more accurately and reliably.

II- At EmpPass, we do not disclose our users' information. Each user owns the data they provide. The platform is committed to protecting such information and maintaining it under strict confidentiality. Under no circumstances will EmpPass share, sell, exchange, or rent to third parties the personal information provided by users.

III- To set up or verify attendance through facial recognition, EmpPass processes a photograph of the face captured by the device's camera. The app may also locally process liveness validation signals, such as blinking, head turning, or keeping the face centered, solely to confirm that a live person is present and not a photo or image.

IV- The facial image is used solely to create the employee's face reference, compare the face when recording attendance, prevent impersonation, and protect the integrity of attendance control. It is not used for advertising, marketing, commercial profiling, or to identify the user outside of the EmpPass service.

V- The facial image sent for registration or verification is transmitted to EmpPass servers through the EmpPass API and is stored in association with the employee and the corresponding company. EmpPass does not sell, rent, or share facial data with third parties for commercial purposes. Technical infrastructure providers only process information when necessary to operate, protect, and maintain the service.

VI- Liveness validations are performed locally on the device before sending the face, and EmpPass does not store those signals as independent data.

VII- Facial data is retained as long as the employee's account or the relationship with the company remains active, or until the company or employee requests to update or delete the face data or delete the account, unless it is necessary to retain information due to legal obligations, auditing, or security purposes.

VIII- The user or the administrating company may request the update, deletion, or unlinking of facial data by contacting EmpPass support.


5- Use of Business Accounts

I- Companies registered on EmpPass must maintain a single active account unless prior authorization has been granted by the EmpPass team.

II- The creation or use of multiple business accounts without notification or approval may be considered a violation of the platform's policies.

III- EmpPass reserves the right to temporarily suspend or disable any account that is under investigation, in order to verify compliance with the terms of use and protect the integrity of the platform and its users.


7- Use of Employee Accounts

I- Each user registered as an employee on EmpPass must be linked to only one active company using their email address.

II- The same email address is not allowed to be simultaneously associated with more than one company within the platform.

III- If the user already has an employee account linked to a previous company and wishes to register with a new organization, they must notify the previous company to request the deactivation of their account before proceeding with a new registration.


10- Rights

I- EmpPass reserves the right to modify, at any time, the presentation and configuration of the platform, as well as these General Terms and Conditions.
